    I will also be going to the Kolkata Consulate to get my H1B stamped in May 2008 (HIB expires Aug 2008). Since getting an appointment at the US Consulate requires a prior payment of visa fees at a Consulate designated bank, I would apprecitae if you would let me know how this process works: I.e: (1) How to pay the visa application fee and the visa issuance fee at that bank; and (2) how to book an appointment at the Consulate at Kolkata.     US needs EB1 and Ph.Ds

    Others not contribute as much

    Actually US needs innovation and good talent. Not all PhD are that extra ordinary.
    One goes through the motions of adding incremental knowledge (that quality also depends of the reputation of the university). Most PhDs struggle from one post doc to another.

    PS: I mylelf dropped out of PhD like many of my friends. My experience was that
    only a few PhD students were doing "good" and relevant research. Rest were very acedemic in nature and all about working on questionable commercial value of DARPA and NSF grants.

    I heard that if the labor is approved and h1b is about to expire, I can apply I-140 under premium processing due to a recent rule change>>>

    You cannot transfer to H4, since the 6 year limit is for the "H" category.

    I dont think you can work on OPT immediately after applying for F1.

    As I think you have another option. I am giving you the conceptual idea, but check with your lawyer to see the exact details....
    => Apply for GC and also apply for F1 (check with lawyer the details).....Keep working with company until H1 expires, then jump into F1 status. Go on an extended vacation from work, maybe without pay. As soon as 140 gets approved apply for 3 year h1 (check details with lawyer), then jump back with company and continue on your new H1 and GC process....who knows you might change your mind about US in a couple of years, after earning all the $$$ and the GC might help you stay for ever...:-)

    Does one have to stick to old employer for 180 days after I-140 is approved before person can start with new employer and port priority date from previous job ?

    my I-140 is pending for than 600 days as well in addition to my pending I-485.
    while using EAD with my current GC applying employer(lets say not
    getting paid as in this economy its hard to find corp to corp jobs), can I
    work another job full time using EAD?

    It is truly amazing how people give advise on legally sensitive issues without verifying the facts. People go to the lengths of suggesting work off the books in an open forum (Admin was right to cut him/her off right away).

    It is always good idea to consult a lawyer on these matters. You may be breaking the law unwittingly.

    AFAIK (I am not a lawyer, consult a lawyer) , you can't work even for free if that job is NOT usually done for free. For example you can't work as a developer for a software development company for free.You may call it volunteer work but it has to be truly volunteer work, meaning others also do this work as volunteers.

    I had the same thing happen to me, applied PP on June19, it reached on 20th got approved on June21. Status still shows pending, but the lawyer got the approval notice with an A# to boot...

    Why are you taking all the H1s into the calculation? This only applies to companies which has more than 50% H1 employees. So it does not apply to all the companies.

    I dont agree with the laws passed, but here is the math to come up with the $600 million figure they are quoting.

    # of possible H1Bs = 85k (65k + 20k)
    Fees (additional) = $2000
    Total Fees = $170 million ($2k x 85k)

    The fee increase is for 4 years = (2010-2014)

    GRAND Total = $680 million ($170 million x 4)

    I am the same boat. My wife got her card wheras I got a response to the SR we raised that my card was sent the same day as my 485 approval notice and it might been lost in mail. I was asked to file I-90. I called customer service several times and talked to 2nd level IO and all suggested to file I-90. I took infopass but gave a shot again by talking to 2nd level IO who went over my case and said that my card was never created so she raised a SR.

    My previous SR was raised by officer at the local uscis office who mentioned non delivery of PR cards which i don't think is the correct request. Now I have to pray and hope they create the card or have to file I-90

    its not mandatory to work while on EAD but did you do a job on EAD at any point of time to get out of H1 status?

    How long can one stay unemployed on EAD? my pd is Nov2005 EB-2
    I got laid-off on Monday I was on H1-b. The employer has notified USICS to withdraw the H1-B. But will not be revoking any GC related stuff. Was on H1-b Laid off 485 pending 180days+ have EAD :(

    looks like this is what happening...

    They have 100's of 1000's of cases....thrown in one dark room.

    They have this Q on their computers, with cases approved Namecheck, background check, I-140, FP complete....

    Now, when they are assigned with a case, they will try to find the file....Just imagine its not easy to find the case, but USCIS doesnt put any effort to sort them either.

    So, he will leave that case there, go to next one...This is just my guess...

    Hi,

    I am working in US on L1 and my company would start my green card filling in next few months.

    I also have valid H1B pettion stamped and can switch to H1B which would mean that I can work freely here at US.

    But many of my friends told me that green card processing is faster on L1.

    I am not able to make decision whether I should continue working on L1 or change my status to H1 to get better hike and more opportunity.

    Pls can anyone tell me which would be wise choice. Is green card processing for L1 visa is faster?

    What is your Bachelors degree in? I know of folks who majored in Psychology but got an MS in Computer Science. I also "heard" of folks with a high school degree or History major who are sought after software engineers. It's a free country, the answer depends on your particular situation, skills and experience.

    In particular: (1) what is your educational background, please be precise, and (2) what is your current work experience? again, "non-engineering" is very vague. please be precise.

    I have come to this forum to ask for some advise because this is one of the forums where lot of the visitors are engineers, and most of them work in computers related fields.
    I have a stable job( non-engineering) and I am making a decent salary(more than 200K/year) right now but I just hate my job.I desperatly want to change my field.
    I am hoping to get my green card next year( PD 06/2004 NSC EB 2 India).I need your advise on how to get into computer/software/IT field.
    I do not have an engineering background but am willing to go back to school. I would like to start working on this transition while I wait for my GC.

    My questions are -
    1- Is there a shortcut of getting into any computer/software or related field ?training,short courses, anything!
    2- If I have to go back to school what major will I need to take? Any specific requirements?
    3-I have a bachelors but not in engineering- can I go straight for a MS in a computer related field or will I have to do a bachelors in Computers first.
    4-How's the current job market and and also if you have any idea/view about future job scenario?
    5-Have any of you made/seen such a transition at my stage?- I am 35, married with working spouse.
    6-Also if somebody can give an idea about salaries in computer related fields?
